Security and protection of your personal data

We consider it our primary task to maintain the confidentiality of the personal data you provide and to protect it from unauthorized access. We therefore take the utmost care and apply the latest security standards to ensure maximum protection of your personal data.

As a company under private law, we are subject to the provisions of the European General Data Protection Regulation (GDPR) and the provisions of the German Federal Data Protection Act (BDSG). We have taken technical and organizational measures to ensure that the data protection regulations are observed both by us and by our external service providers.

 

Definition of terms

Legislation requires that personal data be processed lawfully, fairly and in a manner that is comprehensible to the data subject (“lawfulness, processing in good faith, transparency”). To ensure this, we inform you about the individual legal definitions that are also used in this privacy policy:

 

1. Personal data

“Personal data” refer to any information relating to an identified or identifiable natural person (hereinafter referred to as “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2. Processing

“Processing” refers to any operation or set of operations, whether or not by automated means, which is performed with regard to personal data or with regard to sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

3. Restriction of processing

“Restriction of processing” is the marking of stored personal data with the aim of restricting its future processing.

4. Profiling

“Profiling” refers to any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

5. Pseudonymization

“Pseudonymization” refers to the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures which ensure that the personal data are not attributed to an identified or identifiable natural person

6. File System

“File system” refers to any structured collection of personal data that is accessible according to specific criteria, regardless of whether this collection is managed centrally, decentrally or according to functional or geographical aspects.

7. Person in charge

“Person in charge” refers to a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by EU or Member State law, the person in charge or the specific criteria for its nomination may be provided for by EU or Member State law.

8. Processor

“Processor” refers to a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

9. Recipient

“Recipient” refers to a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with EU or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

10. Third party

“Third party” refers to a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.

11. Consent

“Consent" of the data subject refers to any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

 

Information on the collection of personal data

(1) In the following, we provide information about the collection of personal data when using our website. Personal data are, e.g., name, address, email addresses, user behavior.

(2) If you contact us by email or via a contact form, the data you provide (your email address, your name and telephone number if applicable) will be stored by us in order to answer your questions. Data processing for the purpose of contacting us is based on your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. We delete the data arising in this context after storage is no longer necessary, or processing is restricted if there are statutory retention obligations.

 

Collection of personal data upon visiting our website

(1) When using the website for information purposes only, i.e., if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred
  • Website from which the request originates

Use of cookies

(1) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard disk and assigned to the browser you are using and through which certain information flows to the location that sets the cookie. Cookies cannot execute programs or transfer viruses to your computer. They are used to make the website more user-friendly and effective overall.

(2) Cookies that are required to carry out the electronic communication process or to provide certain functions you have requested (e.g., language settings) are stored on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g., cookies to analyze your surfing behavior) are stored, these are treated separately in this privacy policy.

(3) This website uses the following types of cookies, the scope and function of which are explained below:

a. Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete the cookies at any time in the security settings of your browser.

Passing on the data

(3) In some cases, we use external service providers (processors) to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly monitored. The responsibility for data processing remains with Jagenberg AG.

We use external service providers, e.g., for the dispatch of goods, newsletters or payment processing. A separate contract data processing agreement has been concluded with the service provider to ensure the protection of your personal data.

(4) In order to be able to offer data subjects optimal information and services in accordance with the above-mentioned purposes, information on the contractual relationship (including personal data) is transmitted within the globally operating Kleinewefers Group, to which Jagenberg AG belongs. Those companies within the group that are based outside the EU also ensure an appropriate level of data protection by concluding EU standard contractual clauses. (5) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.

 

Data protection when processing the personal data of our business partners (customers/suppliers; B2B)

(1) As a contractual partner of your company, we process personal data relating to you on the basis of our legitimate interest in preparing offers and fulfilling contracts on the basis of Art. 6 para. 1 lit. f GDPR. Processing for the purpose of bookkeeping and cost accounting as well as for the fulfillment of legal obligations (e.g., commercial and tax law) is based on Art. 6 para. 1 sentence 1 lit. c GDPR. The business relationship exists between us and your company. If you act as a natural person (e.g., as a sole trader or self-employed person), your data will be processed for the implementation of pre-contractual measures and fulfillment of contracts on the legal basis of Art. 6 para. 1 lit. b GDPR.
In the course of external requirements (e.g., in the context of customs/tax law), your personal data may be compared with lists published by authorities.

(2) Furthermore, data may also be processed for legitimate purposes in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, such as marketing, internal market research and marketing purposes, internal statistics. The legitimate interests lie in particular in the optimization of processes and cost-appropriate allocation; your interests, fundamental rights and freedoms are duly taken into account.

(3) We will only use your data to send you information about products, services, events and other interesting facts about our company if you have given us your consent to do so or if we have informed you appropriately as part of data collection in accordance with Section 7 UWG (DE) (Act against Unfair Competition). You can object to this mailing at any time with effect for the future.

(4) The data you provide is required for the performance of the contractual relationship. Without this data, we cannot fulfill the contract concluded with your company.

 

Storage and removal of data

(1) Your data will be stored for as long as is necessary for the above-mentioned purposes. The data will be deleted at the latest after termination of the contractual relationship and after expiry of the statutory retention periods under civil, commercial and tax law.

 

Children

(1) Our offer is generally aimed at adults. Persons under the age of 18 should not transmit any personal data to us without the consent of their parents or legal guardians.

 

Rights of data recipients

(1) We hereby inform you that, pursuant to Article 15 et seq. GDPR, you have the right of access to the personal data concerned, the right to rectification or erasure, the right to restriction of processing, the right to object to processing and the right to data portability under the conditions defined therein. In accordance with Article 77 GDPR, you also have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates this regulation. If the processing is based on Article 6 para. 1 lit. a GDPR or Article 9 para 2 lit. a GDPR (consent), you also have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

(2) Right to information, Art. 15 GDPR

You have the right to request information about whether and to what extent your personal data is being processed (in particular the purpose of processing, recipients of the data, storage period, etc.).

(3) Right to rectification, Art. 16 GDPR

You have the right to request the rectification of your stored data if it is incorrect or incomplete. This includes the right to completion by means of supplementary declarations or notifications.

(4) Right to erasure, Art. 17 GDPR

You have the right to request the erasure of your personal data. This is possible, for example, if the data is no longer required for the purposes for which it was collected or if the data must be deleted due to legal obligations. However, this right may be excluded in individual cases.

(5) Right to restriction of processing, Art. 18 GDPR

You have the right to have the processing of your personal data restricted. This is possible, for example, if your data has been recorded incorrectly or the data processing is unlawful. If processing is restricted, the data may only be processed in strictly limited cases.

(6) Right to data transferability, Art. 20 GDPR

You have the right to request that the data concerning you be handed over to you or to a person responsible to be named by you in a common electronic, machine-readable data format if you have provided this data yourself.

(7) Right to object, Art. 21 GDPR

You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you with effect for the future, provided that the data processing is carried out to protect legitimate interests (cf. Art. 6 para. 1 lit. e, f GDPR). In the event of your objection, we will check whether the legal requirements for the processing of your data are met and, if this is not the case, we will refrain from any further processing of your data.

(8) Right to file a complaint with the data protection supervisory authority, Art. 77 GDPR

You have the right to contact the competent supervisory authority of the EU or the Member States at any time regarding possible violations of data protection regulations.

Use of social media links

(1) We currently use various links to different social media platforms, such as Facebook, Instagram and LinkedIn. These are not social media plugins, but merely links. You can usually recognize the social media elements by the respective social media logos.

The social media links are integrated using the so-called Shariff solution. This solution prevents a connection to a social network from being established simply because you access a page with a social media button without activating it. This means that information is only transmitted to the social network when you use the button.

(2) YouTube

Our website links to the YouTube website. The operator of the pages is Google Ireland Limited; Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC.

For data protection reasons, we have decided – in addition to the embedded videos – to only create a link to this page instead of using YouTube plug-ins. We therefore do not process any of your personal data in this regard, and YouTube cannot automatically collect personal data from you when you visit our website if you are logged out of your YouTube account when you visit our website. This technical solution allows you to decide whether and when you transmit personal data to YouTube. Only if you actively click on the YouTube button will your browser establish a connection to YouTube's servers and transmit your user data to YouTube. YouTube may transfer the processed information to third parties, e.g., US authorities, if this is required by law or if third parties process this data on behalf of YouTube. We have no influence on the type and scope of your data that is processed by YouTube.

(3) LinkedIn

Our website links to the LinkedIn website. The operator of the pages is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland. Instead of using plug-ins, we only link to LinkedIn. Therefore, your personal data is not automatically transmitted to LinkedIn when you visit our website. Through the link, LinkedIn only processes your personal data when you actively click on the LinkedIn button. LinkedIn may transfer the processed information to third parties, e.g., US authorities, if this is required by law or if third parties process this data on behalf of LinkedIn. We have no influence on the type and scope of your personal data processed by LinkedIn.

(4) Instagram

Our website links to the Instagram website. The operator of the pages is Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland. We only link to the Instagram website instead of integrating Instagram plug-ins. This means that your personal data is not automatically transmitted to Instagram when you visit our website. Instagram only processes your personal data when you actively click on the Instagram button. However, if you are logged into your Instagram account at the time you access our website, Instagram will process your personal data. Instagram may transfer this information to third parties, e.g., US authorities, if this is required by law or if third parties process this data on behalf of Instagram. We have no influence on the type and scope of your personal data processed by Instagram.

Use of social media plugins

(1) YouTube with enhanced data privacy

This website integrates videos from the YouTube website. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of these websites on which YouTube is integrated, a connection to YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in extended data protection mode. According to YouTube, videos that are played in extended data protection mode are not used to personalize browsing on YouTube. Ads that are played in extended data protection mode are also not personalized. No cookies are set in extended data protection mode. Instead, however, so-called local storage elements are stored in the user's browser, which contain personal data similar to cookies and can be used for recognition.

After activating a YouTube video, further data processing operations may be triggered over which we have no influence.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time.

Integration of Google Maps

(1) We use Google Maps to display maps, provided that you have consented to the data processing (Art. 6 para. 1 lit. a GDPR). Google Maps is operated by Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043. These pages are marked accordingly. When you access a website on which Google Maps is embedded on our website, a connection to Google's servers is established and your IP and browser data are transmitted to Google. Google may transfer this information to third parties, e.g., US authorities, if this is required by law or if third parties process this data on behalf of Google. The guarantee of an appropriate level of data protection is ensured by certification to the EU-US Data Privacy Framework, to which the provider has registered.

Use of SnazzyMaps

(1) Maps from Snazzy Maps are integrated on the website. We use Snazzy Maps to embed maps from Google Maps in our website with a customized design. The provider is Atmist, 10940 - 166A St Unit 201, T5P 3V5 Edmonton, Canada. These maps are only displayed after clicking on the “Plan your journey” link. After clicking, the user's IP address is transmitted both to the web service snazzymaps.com and to Google Maps, as it is not technically possible to provide the maps without this transmission. Due to the required click on “Plan route”, this transmission takes place in the interest of an appealing presentation of our online offers and to make it easy to find the places we have indicated on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. Google LLC and Snazzy Maps are responsible for further data processing. In addition, SnazzyMaps and/or Google may transfer this information to third parties, e.g., US authorities, if this is required by law or if third parties process this data on behalf of Google. Use of Flockler

(1) We use Flockler, a social media aggregator tool, to curate social media feeds and present social media content that we believe is relevant and inspiring to you. Flockler itself does not store any personal data about your visit. The contractual partner is Flockler Commerce, Inc, 1201 W Peachtree St, NW Ste. 2625 #36051, Atlanta, GA 30309. The Flockler databases are hosted by AWS in Germany. Our service provider AWS or the CloudFront service of AWS receives the incoming data traffic and stores your IP address in its logs for a short period of time. The IP address is processed for our legitimate interest in accordance with Art. 6 para. 6 lit. f GDPR. Our interest lies in ensuring that the CloudFront service can protect Flockler and our social media channels from an unusual volume of traffic and any malicious activity patterns. Your IP address is automatically deleted from CloudFront's logs and is not processed by Flockler or us in any way. However, depending on the platform, the social media services may store information about you if you choose to interact with the content (e.g., play a video or visit our social media profile pages).

Use of Google Analytics

(1) This website uses Google Analytics, a web analysis service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, (“Google”), provided that you have given your consent in accordance with Art. 6 para. 1 lit. a GDPR. Google Analytics uses “cookies” which are text files placed on your computer to help the website analyze how users use the site. The information generated by the cookies about your use of this website (including your shortened IP address) is transmitted to a Google server in the USA and stored there for 14 months. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. (1) The operator of this website uses the Google Tag Manager of Google Ireland Limited, Gordon House, Barrow Street Dublin 4, Ireland (“Google”). A tag is a JavaScript snippet that is used to send information to third parties, such as Google. Google Tag Manager is a tool that allows website operators to manage marketing tags via the Google Tag Manager interface. Google Marketing Platform

(1) This website uses the Google Marketing Platform (DoubleClick) of Google Ireland Limited, Gordon House Barrow Street Dublin 4, Ireland (“Google”) if you have consented to its use and thereby given your consent (Art. 6 para. 1 lit. a GDPR) to data processing. You can revoke your settings at any time via the cookie banner. The Google Marketing Platform uses cookies to display ads that are relevant to users, to improve campaign performance reports, or to prevent a user from seeing the same ads more than once. Conversions can be recorded using a cookie ID if a user visits the advertiser's website and makes a purchase after an ad has been displayed. Your browser establishes a connection to Google's servers to display the advertisement.

By integrating Google Marketing Platform, Google receives the information that you have accessed a part of our website or clicked on our advertisement. If you are registered with a Google service, Google can assign the visit to your account. Even if you are not registered with Google or have not logged in, it is possible that the provider will find out your IP address and store it.
